1. Acceptance of Terms

By installing, opening, or using the FL Offline Fish Check mobile application (the "App"), published by APPFLOW LLC ("APPFLOW LLC", "we", "our"), you accept these Terms of Use in full. If you do not agree, do not use the App.

2. Description of the Service

FL Offline Fish Check is a reference application that provides, offline, information about recreational fishing regulations in Florida (USA) state waters, computer-vision-assisted species identification features, and catch calculation tools.

We are not a regulatory authority. The information shown is a compilation of public sources (Florida FWC, SAFMC, GMFMC, and others) prepared on a best-effort basis, but may contain errors, be out of date, or fail to reflect recent changes in applicable regulations.

3. No Warranty

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

You are solely responsible for:

a) Verifying current regulations at myfwc.com and/or with the relevant authorities before fishing, retaining any catch, or making any legal or financial decision based on the App.

b) Visually verifying any species identified by the App before retention. The App does not replace the fisher's knowledge or consultation of official guides.

c) Complying with all applicable laws, regulations, ordinances, and provisions of the location where you fish. This includes, without limitation, Florida FWC regulations, federal SAFMC and GMFMC regulations, tribal rules if applicable, and the environmental and hunting/fishing laws of your jurisdiction.

d) Making your own decisions about safety, navigation, equipment handling, and catch preservation.

5. Limitation of Liability

To the maximum extent permitted by applicable law, APPFLOW LLC, its directors, employees, contractors, and partners shall not be liable for:

APPFLOW LLC's aggregate liability under these Terms, for any cause, shall not exceed the amount paid by the user in the twelve (12) months preceding the event giving rise to the claim.

6. Indemnification

The user agrees to indemnify and hold APPFLOW LLC harmless from any claims, demands, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

a) The user's use of the App. b) Any breach of these Terms by the user. c) Any violation by the user of any law or third-party rights.

7. Subscriptions, Payments, and Refunds

FL Offline Fish Check offers a free version with limited features and a Premium subscription version, with monthly and yearly plans. Prices are displayed before purchase and may include free trial offers.

8. Intellectual Property

The App, its source code, AI model, designs, curated texts, and databases are owned by APPFLOW LLC or licensed to APPFLOW LLC. Copying, decompilation, reverse engineering, redistribution, sublicensing, or unauthorized commercial use of any part of the App is prohibited.

Some portions of textual content may be derived from open-licensed sources (e.g., Wikipedia under CC BY-SA 3.0). These cases are explicitly attributed in the App's "About" section.

9. Privacy

Personal data handling is governed by our Privacy Policy, available at ./privacy-en.html and accessible from the App's "About" section.

10. Changes to Terms

APPFLOW LLC may modify these Terms at any time. Significant changes will be notified inside the App or through the contact channels the user provided to Google Play or Apple App Store. Continued use of the App after notification constitutes acceptance of the new Terms.

11. Suspension and Termination

APPFLOW LLC may suspend or terminate a user's access to the App or to Premium features if:

a) The user breaches these Terms. b) The user abuses the App (e.g., reverse-engineering attempts, massive data scraping, or fraudulent payment use). c) Required by a competent authority.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any dispute arising from or relating to these Terms or the App shall be submitted to the competent courts located in the county where APPFLOW LLC has its registered legal domicile in Florida, unless the consumer-protection law of the user's country of residence sets a different mandatory forum.

13. Severability

If any provision of these Terms is held invalid or unenforceable by a competent court, the remaining provisions shall remain in full effect.
